How Murtha's Death Could Make It Harder to Pass a Health Care Bill

As the Capitol reacts to the death of Jack Murtha and remembers his legacy, it's worth pointing out that the news will make it even harder for House Speaker Nancy Pelosi to secure the 218 votes needed to pass health care legislation.

Back in November, the House passed its health care bill by a narrow 220 to 215 margin, with 39 Democrats voting against it. Since then, the one Republican who voted for it -- Joseph Cao -- has indicated that he would not support the bill a second time around given the weaker language on abortion in the Senate version. In addition, Florida Rep. Robert Wexler already retired prematurely. Factor in Murtha's death today, and Pelosi is down to 217 votes -- one short of passage. To pass the bill at some point in the next few months, she'll need to flip a Democrat who is already on record voting against the bill. This doesn't even take into account the pro-life Democrats led by Bart Stupak who are prepared to vote "no." While there's been talk that Pelosi had some votes in reserve the first time around, the point is that those members felt they needed to vote against the bill -- and the political environment has deteriorated substantially for Democrats since then. 

With Murtha's death, the Cook Political Report has now moved his Pennsylvania district to the "toss up" category. If Republicans can field a good candidate and gain the seat, it would further reinforce the fears among Democrats in swing districts and make them less likely to jump on board with Pelosi. Chris Cillizza suggests the most likely date for the special election would be May 18. The special election to replace Wexler is scheduled for April 13, and is expected to go Democrat.

Iran's Supreme leader Ayatollah Ali Khamenei said on Monday that Iran is set to deliver a "punch" that will stun world powers during this week's 31st anniversary of the Islamic revolution, AFP reported.

"The Iranian nation, with its unity and God's grace, will punch the arrogance (Western powers) on the 22nd of Bahman, February 11, in a way that will leave them stunned," Khamenei, who is also Iran's commander-in-chief, told a gathering of air force personnel according to AFP.

Red Eye Celebrates Third Year By Topping CNN Prime Time Last Week

MSNBC’s David Shuster became a fan of Fox News’ late-night comedy/news hybrid Red Eye just in time for its three-year anniversary.

And it’s coming at a time when the 3amET show is seeing big ratings in the A25-54 demographic – even topping CNN prime time last week.

Just like when we highlighted the show’s ratings in September 2009 (which the FNC advertising department enjoyed as well, taking out full-page ads in the New York Post and others), the ratings for last week show Red Eye beating CNN again. This time, the show had better ratings in the A25-54 demographic than Campbell Brown at 8pmET and Larry King at 9pmET, and tied Anderson Cooper at 10pmET (Monday-Thursday).

Larry Kudlow to Run for Senate Against Chuck Schumer?

The movement to draft CNBC host Larry Kudlow to run against Sen. Charles Schumer (D-N.Y.) is charging full-speed ahead.

The Draft Kudlow Committee, which is gathering signatures to encourage the conservative economist to run, added former New York Conservative Party State Chairman and co-founder Serphin Maltese to its ranks Tuesday. Maltese joind Buffalo-based PR consultant Michael Caputo and Dr. David Tukey, a former McCain-Palin deputy regional campaign manager based in New York City.

And John Lakian, the group's new finance chair, told the New York Daily News on Friday that Kudlow is "80 or 90 percent" likely to take on the state's senior senator.

TEHRAN (FNA)- Supreme Leader of the Islamic Revolution Ayatollah Seyed Ali Khamenei stressed that the Zionist regime is moving on a precipice towards demise and it will soon experience annihilation.

White House announces televised health meet

President Barack Obama is planning to host a televised meeting with Republican and Democratic congressional leaders on health care reform.

The Feb. 25 meeting is an attempt to reach across the aisle but not a signal that the president plans to start over, as Republicans have demanded, a White House official said.

Marist Poll Shows Majority of Independents for the First Time Disapprove of How Obama is Doing

This Marist Poll Reports:

Obama Approval Rating Below 50%...Disapproval Among Majority of Independents

Fewer registered voters nationwide -- 44% -- currently approve of President Barack Obama’s job performance than disapprove -- 47%. When Marist last asked about the president’s approval rating in December, 46% thought well of Obama’s job performance while 44% gave him low marks.

Perhaps, particularly concerning for Mr. Obama is the drop in support among Independents. For the first time since taking office, a majority of Independents -- 57% -- disapproves of how he is doing in the role. 29% approve, and 14% are unsure.

College Makes Students More Liberal, but Not Smarter About Civics, Study Finds

While many graduates of American colleges cannot answer basic civics questions, a higher education does make their opinions more liberal on controversial social issues, according to a new report issued on Friday by an academic think tank.

The Intercollegiate Studies Institute, an independent group with a tradition-minded view of issues, asked about 2,500 randomly selected people more than 100 questions to gauge their civic knowledge, public philosophy, civic behavior, and demographics.

"The Shaping of the American Mind," the fourth report from the institute on civic literacy, will be formally released on Wednesday.

WASHINGTON - The feds may still try the 9/11 terror thugs near Ground Zero, President Obama said yesterday, shocking critics.

"I have not ruled it out, but I think it's important for us to take into account the practical, logistical issues involved," Obama told CBS News anchor Katie Couric.

"I mean, if you have a city that is saying no, and a police department that is saying no, and a mayor that is saying no, that makes it difficult," Obama acknowledged.

AP Sees What it Wants to See

The Associated Press Sees What Isn't There

The Super Bowl isn't over yet, but commentary on the commercials is in full swing. The Associated Press sums them up as "funny," "light-hearted" and "a return to humor." Here is the AP's description of the Tebow ad:

And a commercial by conservative Christian group Focus on the Family, perhaps the most anticipated ad of the night, hinted at a serious subject although it took a humorous tone too. Heisman winner Tim Tebow and his mother talk about her difficult pregnancy with him and how she was advised to end the pregnancy--implying an antiabortion message--but ended with Tebow tackling his mom and saying the family must be "tough."

Only the ad didn't do any such thing. It said nothing about "how [Mrs. Tebow] was advised to end the pregnancy." There was no mention of abortion.

ALBANY -- Gov. Paterson is lashing out at top aides for the growing debacle surrounding what they consider a "corrupt" Aqueduct gambling deal decision -- and suggesting that they'll soon be fired, The Post has learned.

"He's become paranoid. He sits gnashing his teeth, looking around for scapegoats among the people around him," said a source frequently in contact with Paterson. "He's lecturing them, launching into tirades, and he's demoralized the entire staff in the process."

In response, several Paterson aides have signaled they may quit over what some call his "corrupt decision" to give the lucrative Aqueduct gaming contract to a questionable consortium that includes the Rev. Floyd Flake of Queens, whose political support the poll-challenged governor has aggressively sought.

'Brennan's Lie on Meet the Press'

Marc Thiessen shatters John Brennan's claim that Republicans knew that Abdulmutallab was in FBI custody, therefore they should have known that he would be mirandized:

Yesterday on Meet the Press, Obama counterterrorism adviser John Brennan lashed out at Republicans for daring to criticize the Obama administration’s bungling of the interrogation of Abdulmutallab, the Christmas bomber — and said Republicans should have known he would automatically be Mirandized once the FBI began questioning him.

Brennan claimed that he spoke with four Republicans on Christmas night — Mitch McConnell, John Boehner, Kit Bond, and Pete Hoekstra — and told them that Mr. Abdulmutallab “was in F.B.I. custody” and that they should have understood that “F.B.I. custody” meant reading Miranda rights in a civilian process.  “None of those individuals raised any concerns with me at that point,” Brennan said.

The problem with Brennan’s claim?

As I point out in Courting Disaster, just a few months earlier, the Obama administration announced that its new FBI-led “High-Value Interrogation Group” (HIG) would not necessarily Mirandize suspects it was questioning.

In its story on the announcement, the Washington Post reported:

Interrogators will not necessarily read detainees their rights before questioning, instead making that decision on a case-by-case basis, officials said. . . . "It’s not going to, certainly, be automatic in any regard that they are going to be Mirandized," one official said, referring to the practice of reading defendants their rights. "Nor will it be automatic that they are not Mirandized."

Republican lawmakers are denying a charge made by top White House counterterrorism official John Brennan that they were briefed about -- and did not object to -- the decision to offer full American constitutional rights to accused Detroit bomber Umar Farouk Abdulmutallab.

On "Meet the Press," Brennan said that on Christmas night, just hours after Abdulmutallab tried to blow up Northwest Airlines flight 253, Brennan called GOP Senators Mitch McConnell and Christopher Bond, as well as Republican Representatives John Boehner and Peter Hoekstra, and told them that Abdulmutallab was in FBI custody. "None of those individuals raised any concerns with me at that point," Brennan said. "They didn't say, Is he going into military custody? Is he going to be Mirandized?"

Each of the lawmakers strongly denies Brennan's account. A spokesman for McConnell says, "During a brief call from the White House, Sen. McConnell was given a heads up that Abdulmutallab was in custody, but little else. He wasn’t told of the decision to Mirandize Abdulmutallab."
