Attorney General Mukasey and Deputy Attorney General Filip Write that the OPR Did 'Shoddy Work'

Attorney General Mukasey and Deputy Attorney General Filip Shredded OPR's Misconduct Allegations Against Bush Lawyers   [Andy McCarthy]

The Justice Department last night released the Office of Professional Responsibility’s report clearing Bush-era attorneys of professional misconduct. The baseless claims of ethical lapses stemmed mostly from 2002 legal opinions issued by DOJ’s Office of Legal Counsel in connection with the CIA’s interrogation program.

 

For whatever reason, when the Justice Department released its report to Congress, inevitably ensuring that it would be made public, it did not release a crucial letter to OPR written by the Bush Justice Department’s two highest officials, Attorney General Michael Mukasey and Deputy Attorney General Mark Filip. That letter, dated January 19, 2009 (the last full day of the Bush administration), shredded OPR’s initial Draft Report and the process by which OPR's preliminary conclusions about ethical misconduct were reached.

 

I have obtained a copy of that letter and I am releasing it here on NRO this morning.  It can be found here.

 

Messrs. Mukasey and Filip are both distinguished former federal judges, and their 14-page analysis of OPR’s shoddy work is withering.  The letter ought to be read in full, but here are some highlights:

Andrew Breitbart has had an Interesting CPAC and Here He is Called a Racist

For those you who followed our extensive coverage of Max Blumenthal’s character assassination attempt of James O’Keefe, a fringe blog called One People’s Project was the key source in Blumenthal’s research.  Darlye Jenkins, who runs the blog One People’s Project, stopped by CPAC, according The Washington Independent’s Dave Weigel, “for the express purpose of confronting [Andrew] Breitbart.”  Here is footage of that confrontation:

The reason why One People’s Project was not the focus of our ire during the Blumenthal scandal is because, as Breitbart succinctly put it in this video, they are not accountable to any standard of journalism.  Unlike for Salon.com, there is little at stake for them if they fail to tell the truth (not to mention the scope of their readership and influence is comparatively menial).  That still is the case, and it goes without saying we are giving Mr. Jenkins and his blog publicity simply by posting this video, but we’ll indulge him this time around.

We’ll indulge him because we believe this encounter is illustrative of tactics the left employs far too often when they engage in verbal fisticuffs–calling their ideological opponents “racists” or some other invective, selectively ignoring essential details of the story when it’s advantageous to their cause–but it’s also illustrative of tactics the right doesn’t use often enough.  Breitbart is one of the few high profile conservatives in the media today ready and willing to take the fight to the left the way they’ve always taken it to us (I’m a former Berkeley College Republican, I know).  As White House Deputy Chief of Staff Jim Messina famously said, “If you get hit, we will punch back twice as hard.”  Breitbart has turned the left’s tactic back on them and the net result is an offensive conservatism that’s been largely absent from political discourse in recent memory.  And if the cheers at the tail end of this video are any indication, we would probably benefit from a few more confrontations like this one.

It makes me so happy to see that we conservatives have Andrew Breitbart on our side who is not afraid to take on and destroy the liberal media and Hollywood. It is amazing that he can show so much restraint when being called a racist or so many other wonderful things. I have been following Mr. Breitbart for over two years now and one can tell that his demeanor has definitely changed and one could say that it was definitely seen in his speech that he gave today. He was always combative and not afraid to take on the liberal media, but from what I can tell, he has gotten even more angry with the left's slandering of conservatives and his mission is to do everything in his power to not back down and not let them win the battle. I'm proud that Andrew Breitbart is fighting and taking on the liberal media and as long as we have him on our side, liberals should just watch out.

Andrew Breitbart Never Backs Down and He Really is on Fire and Here He is Taking on Max Blumenthal

Via Big Journalism. I’m kicking myself for not having covered this at the time because most of you won’t know the background before watching. Briefly, lefty smear merchant Max Blumenthal dropped a hit piece on O’Keefe at Salon a few weeks ago alleging that he had helped plan some sort of white-supremacist conference in 2006, and even manned a table there at which racist literature was being sold.

Minor problem one: It wasn’t a white-supremacist conference. It was a debate on “Race and Conservatism” featuring a panel discussion between mainstream conservatives and racist radicals. Among the mainstreamers was Kevin Martin, a black conservative who spoke up after the Salon piece was published to say that O’Keefe chatted with him at the conference and “voiced personal support for me and my positions. He also repudiated the radical elements in the room that night.”

Minor problem two: Dave Weigel of the Washington Independent, the alleged source for the detail about O’Keefe manning the table with racist lit, also spoke up after Blumenthal’s piece hit to say that he had no reason to believe O’Keefe had helped plan the event and had never claimed that O’Keefe manned a table there.

And those weren’t the only “minor problems.” The end result: Salon had to formally retract the detail about O’Keefe planning the event, although as far as I know, the fact that O’Keefe reportedly told Kevin Martin he was on his side remains unreported.
